Victims' Welfare Act: § 90a of the War Victims' Act now applies mutatis mutandis from 1 September 2026
§ 2(2) of the Opferfürsorgegesetz (Austrian Victims' Welfare Act 1947) is amended to add § 90a of the Kriegsopferversorgungsgesetz 1957 (War Victims' Benefits Act) to the list of provisions that apply by analogy. The change takes effect on 1 September 2026 and concerns persons recognised as victims of Nazi persecution or political persecution in Austria.
What changed
Section 2(2) of the Victims' Welfare Act now includes § 90a of the War Victims' Benefits Act 1957 in the catalogue of provisions that apply to recognised persecution victims by analogy. Previously, § 90a was not listed among the cross-referenced sections. Additionally, several editorial annotation labels were removed from the document and the metadata URL was updated.
Who is affected
Persons who hold an official certificate (Amtsbescheinigung) or a victims' identity card (Opferausweis) issued under the Victims' Welfare Act — that is, survivors and successors of those who fought for a free democratic Austria or suffered political persecution under the Nazi regime.
What to look out for
The amended § 2(2) enters into force on 1 September 2026 (BGBl. I Nr. 49/2026). Beneficiaries or their advisers should check whether § 90a of the War Victims' Benefits Act grants any additional entitlements or procedural rights relevant to their individual situation.
