Austrian court fees raised across all tariff categories effective 1 August 2026
The Federal Minister of Justice has adjusted court fees (Gerichtsgebühren) upward based on the March 2026 Consumer Price Index. The new amounts apply to all court filings and official acts where the fee obligation arises after 31 July 2026.
What changed
All 15 tariff schedules (Tarifpost 1–15) and several fixed thresholds in the Court Fees Act have been increased, typically by around 5–6%. For example, the minimum civil-lawsuit fee rises from €31 to €33, the land-registry flat fee from €28 to €30, and the cap in §26 from €578 to €611.
Who is affected
Anyone who files a lawsuit, registers a property transaction, initiates insolvency proceedings, or requests any other official court act after 31 July 2026 will pay the higher fees. This includes private individuals, businesses, and legal professionals acting on their behalf.
What to look out for
Almost all changes take effect on 1 August 2026. One sub-provision (Tarifpost 14 lit. b) is delayed and takes effect on 1 January 2027, applying to fee obligations arising after 31 December 2026. The triggering date is when the fee claim arises, not when you pay.
