B-GlBG: EU Pay Transparency Directive added; Dienstrechts-Novelle 2025 amendments in force since 1 April 2025
The Federal Equal Treatment Act (B-GlBG) now lists the EU Pay Transparency Directive (2023/970/EU, CELEX 32023L0970) as one of the EU directives it implements. A new § 47 paragraph 34 confirms that several provisions were amended by the Dienstrechts-Novelle 2025 (BGBl. I Nr. 100/2025) and entered into force on 1 April 2025.
What changed
The EU Pay Transparency Directive (Directive 2023/970/EU, CELEX 32023L0970) was added to the implementation references of the Act. A new entry — § 47 para. 34 — records that a broad set of provisions was amended by the Dienstrechts-Novelle 2025 (BGBl. I Nr. 100/2025) and took effect on 1 April 2025.
Who is affected
Federal civil servants and federal authorities subject to the Federal Equal Treatment Act (B-GlBG — Bundes-Gleichbehandlungsgesetz). Equal treatment commissioners (Gleichbehandlungsbeauftragte) and equal treatment commissions (Gleichbehandlungskommissionen) are particularly affected.
What to look out for
The 1 April 2025 amendments touch harassment rules (§ 12), women's promotion plans (§ 20c, § 20d), equal treatment commission procedures (§ 22, § 22b, § 23a), and related sections (§§ 6a, 16b, 24, 30, 32, 40). Because the EU Pay Transparency Directive is now listed as implemented, pay-related equal treatment obligations should be read in light of that Directive.
